Tony Martins Gym Limited [8438524] (we, us or our) are committed to complying with the requirements of the Privacy Act 2020 (Act) in relation to personal information that is collected by us from and about members.
This policy relates to the collection, use, disclosure and protection of any personal information we collect in relation to members. By becoming a member, you are deemed to have read, and agree to be bound by, this Privacy Policy.
This policy does not limit or exclude any of your rights under the Act.
We may change this policy by uploading a revised policy onto our website. The change will apply from the date that we upload the revised policy.
What we collect and when
We collect personal information about members when members:
- sign up with us and obtain a membership (such as name, date of birth, address, telephone number, email address, credit card details, and medical information);
- use our website, including through any communications you have with us (such as internet protocol (IP) address);
- use our facilities (such as time of entry and exit, and CCTV footage (see separately below)).
Any third party that we use to process membership applications or payments may also collect your personal information. Please refer to the relevant third party’s privacy policy for further details.
Our use of personal information
We may use your personal information:
- to verify your identity;
- to provide you with services and communicate with you about those services;
- to send you information about services and promotions that may be of interest to you;
- to administer your account;
- to monitor activity on our website and to protect the security and integrity of our website;
- to enforce or apply our terms and conditions;
- to provide, at a cost, to third parties for legitimate business purposes such as research, marketing, service enhancement, and business development;
- to invoice you and to collect money that you owe us, including authorising and processing credit card transactions;
- for security purposes (CCTV footage) to:
- take steps to ensure the security and safety of our members, staff and other visitors,
- take steps to prevent damage to our premises and equipment,
- for any other use that you authorise.
We may provide your personal information:
- to our related companies;
- to any debt collection agencies or lawyers or other entities to recover any money you owe to us and to exercise any rights we may have against you;
- to any payment processing organisations;
- to any parties that supports our services and products, including any person that hosts or maintains any underlying IT system or data centre that we consider necessary in providing you access to our website or systems;
- To a third party for:
- legitimate business purposes such as research, marketing, service enhancement, and business development;
- law enforcement (such as the Police);
- to any person that can require us to supply your personal information (e.g., regulatory authority);
- where such disclosure is required or permitted by law under the Act or otherwise; and
- to any person authorised by you.
Storage of Personal Information
Any personal information you provide to us will be collected and stored by us in New Zealand.
How long do we hold personal information
Personal information will be retained only for as long as is necessary to fulfil the purposes for which the information was collected (including any time that we are required by law to retain such information).
We will take reasonable steps to keep your personal information secure, safe from loss, unauthorised activity, or other misuse. However, we cannot prevent, and are not responsible for, interception or “hacking” of information transmitted by us or to us. Accordingly, any information transmitted is at your own risk.
Privacy Breach
If we believe there has been a privacy breach, we will take steps to identify the issues and minimise any harm. If we believe that the breach has caused, or is likely to cause, serious harm then we will comply with our obligations under the Act. As soon as practicable after becoming aware that the breach has occurred, we will notify the Privacy Commissioner and (if required under the Act) and the individuals who may have been affected.
Please contact us as soon as possible if there has been a privacy breach which affects you.
Access and Correction
You are entitled to access and correct your information at any time by contacting our privacy officer by emailing that person at membership@tonymartins.co.nz.
Where that personal information forms part of CCTV footage , your right to access that footage can only relate to information held about you and no other person. We do not guarantee the length of time that we may hold CCTV footage and it may not exist at the time of any request.
Cookies
We may set and access cookies on your computer. Cookies are text files that identify your computer to our server, so that when you visit our website, the cookie will identify your computer to our web server. This allows us to improve the speed and reliability of the website and provide you with a better service. You can disable cookies by changing your Internet browser settings. However, if you do not enable cookies, our website may not function as intended.

If you are a member, you may receive emails from us regarding products, services and promotions that may be of interest to you, and we may send you updates (or notifications of updates) of our Terms and Conditions. You can opt out of these emails at any time.
